Compass Group does not engage in any export business from this site.

TRANSACTION FEE.
Compass Group Ltd will charge a transaction fee as disclosed on the Payment pages for each online transaction undertaken through this site.
Refund Policy.
Compass Group Refund Policy is as follows.
Compass Group will not refund sums held in the student accounts during the semester. Anyone requesting a refund of monies held to their student account must make written submission to refunds@compass-group.co.nz providing details of their bank account and monies will be transferred at the end of the Semester in which the request was made.
Compass group will not make any refunds of Student Accounts from their till system on any Campus.
SECURITY CAPBILITIES AND POLICY FOR THE TRANSMISSION OF PAYMENT CARD DATA.
Customer card data is captured using Payment Express Hosted Payment Page - PxPay 2.0
The PX Pay 2.0 interface is a third party Hosted Payments Page (HPP) solution provided by Payment Express. The HPP provides a solution for the capturing credit card information securely without exposing the merchant to the sensitive data. This is achieved by allowing the card holder to enter their card details into a page which is hosted by Payment Express rather than the merchants own website. The major advantage of this approach is that the merchant does not see, and is not aware of, the card number at any point in the process. Payment Express is registered as a PCI DSS compliant service provider; therefore, a payment page solution hosted by Payment Express meets all PCI DSS requirements.
Security and Infrastructure
Payment Express have a dedicated development and data centre specially designed for payment processing. Payment Express are fully certified and compliant with Visa AIS (Account Information Security) and MasterCard SDP (Site Data Protection) (PCI-DSS) at processor level; using Ernest and Young Risk Management for quarterly scans on systems and full onsite audits, annually.
Payment Express own all internal networking and security infrastructure, including dual Host systems and cold stand-by at the IBM data centre, dual UPS, multi-ohm internet connectivity, failover switches and backup generators. We also have a host system based in Sydney for our Australian customers and a private GPRS network, in Australia and NZ, for wireless payment processing.

TERMS OF USE
If you use Compass Group Ltd student account portal then the following terms of use will apply.
Definitions
“Agreement” means these terms of trade and any variation updated from time to time.
"Account holder" means an individual or organisation who has registered as an account holder with Compass Group #itsyourchoice ,who is also a party under this agreement.
"Term" means the period commencing on the date of this Agreement, and ending on the date this agreement is terminated.
"Website" means the website located at www.YoutchoiceAuckland.co.nz and www.YourchoiceManawatu.co.nz or any related services,
"We", "Us", and "Our", means Compass Group Ltd.
"You", "yourself" and "your" means the Account holder. The plural includes the singular and vice versa.
AGREEMENT.
Compass Group Ltd agrees to provide the Service to you in accordance with this Agreement.
Add Value On-line.
The account holder may add value to your student account on-line.
The account is deemed to be topped up when a payment has been made from any EMV card or bank debit card or a bank to bank transaction and a receipt is generated.
Students will be able to lock their account on-line and also view statements of their spending with Compass Group at the Massey Cafeteria’s on-line

CONFIDENTIALITY AND INTELLECTUAL PROPERTY
The Account Holder agrees that all Intellectual Property rights relating to the service and the website are owned by Monitor Business Machines Ltd and will not:
Display, copy, print, reproduce, adapt, reverse-engineer, distribute, store, publish or create derivative works using the Intellectual Property or the Confidential information: or
challenge, nor assist any other party (directly or indirectly) to change Monitor Business Machines Ltd sole ownership of the Intellectual Property, nor to use the same in services to any other party
The obligations under this clause shall survive termination of this Agreement.
LIABILITY AND INDEMNITY
You agree to be solely responsible for the customer and fully indemnify Compass Group Ltd and its directors, employees and authorized representatives from any and all claims, liabilities, losses (including consequential loss), expenses and damages occasioned by reason of any claim, proceeding, action, liability or injury in connection with any matter arising directly or indirectly from breach of this agreement by, its employees, authorized representatives or agents.
To the extent permitted by the law, Compass Group Ltd excludes all liability and responsibility to the Account Holder in connection with the service, the website, or any acts or omission by other users, supplier liability of Compass Group Ltd to the Account holder relating to this agreement shall be limited to the total value of all amounts received by Compass Group Ltd under this agreement to a maximum of $1,000.00 New Zealand dollars
DISPUTE RESOLUTION
If any dispute arises between the parties out of or in relation to this Agreement:
the party claiming a dispute has arisen must give written notice to the other specifying the nature of the dispute; the parties will endeavor, in good faith, to negotiate a resolution of the dispute;
if the parties have not resolved the dispute within fourteen (14) days after the date notice of the dispute was given, the dispute is to be mediated by a mediator jointly agreed by the parties, or, if they parties are unable to agree, select by the President of the Auckland District Law Society at the time the dispute arises. The cost of the meditation shall be shared equally between the parties unless otherwise agreed in the course of mediation.
Pending resolution of the dispute, this Agreement will remain in full force and effect without prejudice to either parties' rights and/or remedies.
MISCELLANEOUS
The parties shall not be liable for delay or failure to perform its obligations if the cause of the delay or failure is beyond its control.
Failure by the parties to enforce any of the terms and conditions contained in this contract shall not be deemed to be a waiver of any of the rights or obligations it has under this contract.
This agreement shall be governed by and interpreted in accordance with the laws of New Zealand. The Courts of New Zealand have jurisdiction to hear any dispute in connections with this Agreement.
This Agreement contains the entire agreement and undertaking between the parties with respect to the subject matter hereof and supersedes all prior discussions, representations, understandings and agreements weather oral or in writing including, without limitation, the Non-Disclosure Agreement
If any provision of this contract shall be invalid, void or illegal or unenforceable they validity existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.
Compass Group Ltd may vary the terms and conditions contained in this Agreement from time to time, in its absolute discretion. You are deemed to have accepted such change by continuing use of the service and/or the website.
